Welcome to Home Tax Defense
These terms govern your use of our website and services. By using Home Tax Defense, you agree to these terms. We've tried to keep this straightforward and readable — legal docs don't have to be a punishment.
What We Do
Home Tax Defense provides tools and guidance to help Texas homeowners prepare property tax protest packets. We help you document your property's condition and organize evidence for your protest.
Important: We are not a law firm and do not provide legal or tax advice. We provide information and tools to help you navigate the property tax protest process on your own. Nothing on this platform — including generated packets, comp analysis, or any other content — constitutes legal, tax, or financial advice. For advice specific to your situation, consult a licensed professional.
Your Account
When you create an account, you're responsible for keeping your login credentials secure. You're also responsible for all activity that happens under your account. If you think someone else has accessed your account, let us know right away.
You must be at least 18 years old to use our services. By creating an account, you represent that you meet this requirement.
Your Property Information & License Grant
You own the information and photos you upload to Home Tax Defense. Full stop. By uploading content, you grant Home Tax Defense LLC a limited, non-exclusive license to store, process, and display that content solely for the purpose of providing the service to you. We use it to build your protest packet — nothing else.
We never sell your data. Your property information stays private unless you choose to share it — for example, by requesting a contractor estimate.
You're responsible for the accuracy of the information you provide. Make sure your property details and photos accurately represent your property's condition. Submitting false or misleading information to an appraisal district is your responsibility, not ours.
Paid Subscriptions & Auto-Renewal
Some features of Home Tax Defense require a paid subscription. Before you're charged anything, the price and billing interval will be clearly displayed. No surprises.
Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. We'll send you a reminder email before your subscription renews. You can cancel anytime from your account settings — cancellation takes effect at the end of your current billing period, so you'll keep access until then.
If you're not satisfied with a paid service, contact us within 30 days of your charge and we'll work with you to make it right.
Account Deletion & Data Retention
You can delete your account at any time from your account settings. When you delete your account, we may retain your data for up to 30 days. This allows you to recover your account if you change your mind, and helps us improve our services through internal analysis.
Your data is never sold. We don't share your information with third parties unless you explicitly request it (for example, requesting a contractor estimate). After 30 days, your account and all associated data are permanently deleted from our systems.
If you need your data deleted immediately without the 30-day retention period, contact us at support@hometaxdefense.com and we'll process your request promptly.
No Guarantees on Results
While we help you build a strong protest packet, we can't guarantee any specific outcome. Property tax decisions are made by your local appraisal district or appraisal review board, not by us. Many factors affect whether a protest succeeds, and we have no control over or relationship with any appraisal district.
Acceptable Use
Use our service for its intended purpose: preparing legitimate property tax protests for properties you own or are authorized to represent. Don't use our service to:
- Submit false or misleading information
- Access accounts that don't belong to you
- Interfere with or disrupt our services
- Reverse engineer or attempt to extract our source code
- Violate any laws or regulations
Service Availability
We do our best to keep Home Tax Defense running smoothly, but we can't promise 100% uptime. We may need to temporarily take the service offline for maintenance or updates. We're not liable for any inconvenience caused by downtime.
Limitation of Liability
Home Tax Defense provides tools and information to assist with your property tax protest. We're not responsible for decisions made by appraisal districts, errors in public property records, or the outcome of your protest.
To the maximum extent permitted by law, our total liability to you for any claims arising from your use of our service is limited to the amount you've paid us in the past 12 months. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.
Indemnification
You agree to defend, indemnify, and hold harmless Home Tax Defense LLC and its members, officers, and employees from any claims, damages, or expenses (including reasonable attorney's fees) arising from: your use of the service, content you upload, your violation of these terms, or your violation of any third-party rights. We'll give you prompt notice of any such claim and cooperate reasonably in your defense.
Dispute Resolution & Arbitration
We'd rather work things out directly. If you have a dispute with us, email support@hometaxdefense.com first and give us 30 days to resolve it informally. Most issues can be handled this way.
If we can't resolve the dispute informally, you and Home Tax Defense LLC agree to resolve it through binding arbitration rather than in court. Arbitration is less formal than a lawsuit and uses a neutral arbitrator instead of a judge or jury. The arbitration will be conducted under the rules of the American Arbitration Association (AAA) and will take place in Texas.
Exception: Either party may bring an individual claim in small claims court if it qualifies. This arbitration agreement does not prevent you from filing a complaint with a regulatory agency.
No Class Actions
You and Home Tax Defense LLC agree that disputes will be resolved only on an individual basis. You may not bring claims as a plaintiff or class member in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Governing Law
These terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Tarrant County, Texas.
Changes to These Terms
We may update these terms from time to time. The "Last updated" date at the top of this page reflects when changes were actually made. If we make significant changes, we'll notify you through the service or by email. Your continued use of Home Tax Defense after changes take effect means you accept the new terms.
